Please read these Terms of Service carefully before using [APP NAME]. By creating an account or sending a card, you agree to be bound by these terms. If you do not agree, do not use the service.

1. The Service

SendWell Cards is a web-based application that allows registered users to send physical postcards and greeting cards via the United States Postal Service. Users may select from curated card templates, upload personal images, and compose messages. Cards are printed and mailed by our third-party fulfillment partner, Lob Technologies, Inc.

The Service is intended for personal, non-commercial use --- specifically for individuals sending cards to friends, family, and acquaintances.

2. Eligibility

You must be at least 18 years of age to use this Service and create an account. By using the Service, you represent and warrant that you meet this requirement.

3. Account Registration

SendWell Cards uses passwordless authentication. You register and log in using your email address. You are responsible for maintaining access to that email account and for all activity that occurs under your account. Notify us immediately at help@darkcitytech.com if you suspect unauthorized access.

4. Payments and Pricing

4.1 Pricing

Card pricing is displayed at checkout before payment is collected. Prices are subject to change with reasonable notice. The price shown at the time of your order is the price you will be charged.

4.2 Payment Processing

All payments are processed by Stripe, Inc. We do not store your credit card number or payment credentials. By submitting payment, you agree to Stripe's Terms of Service. A transaction processing fee is included in the displayed price.

4.3 Refund Policy --- Please Read Carefully

Because physical cards enter the print and mail queue within minutes of a confirmed payment, we are generally unable to cancel or refund orders once payment is confirmed. Specifically:

5. Address Accuracy and Delivery

You are solely responsible for ensuring that any mailing address you enter --- or that a recipient enters via a claim link --- is accurate and complete. We perform basic address validation through our fulfillment partner but cannot guarantee delivery to incorrectly formatted or non-existent addresses.

Estimated delivery times are provided by USPS and are not guaranteed. We are not liable for delays caused by USPS or other postal services.

6. Claim Link Feature

The claim link feature allows you to send a card without knowing the recipient's address. A unique, time-limited link is generated and shared with the recipient, who then enters their own mailing address.

8. User-Uploaded Content

When you upload an image for use on a card, you represent and warrant that:

By uploading an image, you grant us a limited, non-exclusive license to store and use that image solely for the purpose of printing and mailing your card. We do not claim ownership of your content and will not use it for any other purpose.

9. AI-Generated Content

SendWell Cards may offer AI-generated message suggestions to assist you in composing card text. These suggestions are generated automatically and are provided as-is. You are solely responsible for reviewing, editing, and approving any message before sending. We are not liable for the accuracy, appropriateness, or impact of AI-generated suggestions that you choose to use.

10. Intellectual Property

All card templates, designs, branding, and content created by [YOUR COMPANY NAME] are our exclusive property and may not be reproduced, downloaded, or used outside of the Service without express written permission.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that cards will be delivered within any specific timeframe.

To the maximum extent permitted by law, Dark City Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including but not limited to failed deliveries, printing errors by our fulfillment partner, or misuse of the claim link feature.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for the specific order giving rise to the claim.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine you have violated these Terms. You may delete your account at any time by contacting us.

We do not sell your personal information to third parties. We do not use your data for advertising purposes.

15. Third-Party Services and Data Sharing

We share your data with the following third parties only as necessary to operate the Service:

Lob Technologies, Inc. (Print Fulfillment)

Recipient mailing addresses are transmitted to Lob to enable printing and mailing. Lob's privacy policy governs their handling of this data. We transmit only the data required for fulfillment.

Stripe, Inc. (Payment Processing)

Payment data is collected and stored by Stripe. We receive only a transaction confirmation and anonymized payment details. We never store your full card number or CVV.

Supabase, Inc. (Database and Authentication)

Your account data, order history, and saved addresses are stored in a Supabase-hosted database. Supabase operates under industry-standard security practices.

Anthropic, PBC (AI Message Suggestions)

If you use the AI message suggestion feature, the occasion type and any context you provide are sent to Anthropic's API to generate suggestions. We do not send your name, email, or recipient information to Anthropic.

We use industry-standard security practices including encrypted data transmission (HTTPS), secure credential storage via Supabase, and we never store payment credentials directly. However, no system is perfectly secure. We encourage you to use a secure email account and notify us immediately of any suspected unauthorized access.

19. Children's Privacy

This Service is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has used the Service, contact us and we will take appropriate action.

20. Changes to These Terms

We may update these Terms and Privacy Policy from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

21. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Buncombe County, North Carolina.
